Transferring employees from various branches of the freight forwarding companies to other European countries
The companies are taking advantage of the globalization process by sending their employees to work in their branches located in other European countries. This is a common practice for the member companies of the European logistics network. Transferring experienced employees to other European countries allows for the maintenance of the high level of freight forwarding services offered throughout Europe. In distribution logistics and Europe-wide groupage transport service, the cargo is accompanied by employees of the member companies of the forwarders throughout Europe.
Equal conditions for minimal wage for the employees from member countries of the EU for temporary jobs in other countries from the EU
The employees work under the same conditions in each of the country members of the EU, as the local employees do. This is true for the minimal wage as well as the other work conditions in the respective country.
The law on wages and the social dumping in Austria – an important law for sending employees to Austria as well as for hiring employees there from other countries
Effective since January 1st 2017, when you send an employee to work in an Austrian company, or when a foreign resident is hired to work there, the new legal requirements of the Law for wages and social dumping need to be adhered to (Lohn- und Sozialdumping-Bekämpfungsgesetz – LSD-BG).
Documents for the employees which the freight forwarders need to present for freight forwarding to and from Austria, as well as for transit there
When employees from a member company of the European logistics companies need to enter Austria or to pass through Austria transit, the logistics company must send an electronic notification for this entering or passing through, regardless of whether an Austrian company is part of this service. This notification requirement applies to all freight forwarders Europe, which are not Austrian.
The requirement applies for freight forwarding services to and from Austria, as well as for cabotage transport to Austria and transit through Austria, in the cases when the initial and final destination of the transport is close to the Austrian federal border.
Requirements for remuneration, working hours and annual leave for Austrian citizens, who work for companies based in other European countries
If the employees of a company from the European network for transportation work in Austria, for a logistics company based outside the country, they have the right to the same wages, working hours and annual leave in accordance to the Austrian laws

The center competent in the field of law enforcement is the Vienna Regional Health Insurance Fund (Wiener Gebietskrankenkasse).
Information regarding the requirements for employees of the companies of freight forwarders network in other countries
Paragraphs 19-24 of Section 4 of the Law set the formal requirements when sending employees from the European logistics association to work in another European country.
Consequences from failure to comply with the Law on wages and social dumping
In the cases of repeated failure to comply with the notification requirements, the specified payment in accordance with the law and other violations, apart from administrative measures, a prohibition of the company for logistic transport within Austria for at least one year will be imposed. The maximum period of prohibition is five years.
